1. Who we are

Over The Fence is a Long Island homeowner publication operated by STER GROUP LLC d/b/a EXIT Realty Achieve, 956 W Jericho Turnpike, Smithtown, NY 11787, a licensed New York real estate broker. Jeff Mistretta, Owner/Broker. In these terms, "we", "us", and "our" refer to STER GROUP LLC.

2. Acceptance of these terms

By using this website or joining the Over The Fence community, you accept these Terms of Use. If you do not agree to these terms, do not use the site.

3. Eligibility

Members must be at least 18 years old and have a residential address in Nassau or Suffolk County, New York.

4. What this is, and what it is not

Over The Fence publishes local information for Long Island homeowners and renters. It is a publication, not a real estate brokerage service.

Membership does not create an agency, brokerage, fiduciary, or client relationship between you and us, or between you and any agent affiliated with us. We are not your agent unless you separately sign a written agreement with us. Nothing on this site constitutes an offer of representation.

5. Informational content only

Nothing on this site is legal, tax, financial, investment, insurance, or appraisal advice. Any home value figure shown on this site is an informational estimate, not an appraisal, and must not be relied on for any transaction, refinance, tax filing, or legal purpose.

6. Government deadlines and municipal information

Deadlines, filing procedures, contact information, and other municipal details published on this site change without notice. You must confirm anything time sensitive directly with the applicable government office before relying on it. We make no guarantee of the accuracy or currency of this information.

7. Your account

You agree to provide accurate information when you join and to keep it current. You are responsible for all activity that occurs under your account.

8. Communications and consent

Email consent and SMS consent are separate and independent. You may agree to one, both, or neither. Neither form of consent is a condition of membership.

SMS messages are limited to no more than 2 messages per member per calendar month. You may reply STOP to opt out at any time, and reply HELP for help. Message and data rates may apply. An opt-out on any channel is honored across all channels.

Mobile opt-in data and SMS consent are never shared with third parties or affiliates for their marketing purposes.

We do not purchase, rent, or accept phone numbers or SMS consent from any third party. Every phone number we message was submitted directly to us by the person who owns it.

9. The monthly drawing

The monthly drawing is governed by the separate Official Rules published for each month, which control in the event of any conflict with these terms. No purchase is necessary to enter or win. You do not need to be present to win.

10. Points, tiers, and recognition

Points and tiers are recognition only. They have no cash value, cannot be exchanged, transferred, or redeemed, and have no effect on drawing odds. We may adjust or discontinue the recognition program at any time.

11. Sharing and referrals

Members may share a personal link to invite neighbors to join Over The Fence. Sharing is entirely optional.

We never send a text message to anyone who has not personally opted in. Sharing a link does not cause us to message the person it was shared with. Anyone who joins through a shared link completes our signup form themselves and provides their own separate consent for email and for SMS. We do not collect, purchase, or accept phone numbers from third parties, and we do not send messages on behalf of any third party.

Bonus drawing entries are awarded for community signups only. They are not compensation for the referral of real estate business, are not tied to any real estate transaction, and do not depend on anyone using any agent's services. Self referral and duplicate account creation are prohibited and may result in removal from the community.

12. Local business and vendor directory

No business pays to be listed or covered on this site. A listing is not an endorsement, recommendation, or warranty of any kind. We are not responsible for any work performed or services provided by a listed business. You deal with vendors at your own risk and should verify licensing and insurance independently before hiring anyone.

13. Acceptable use

You agree not to use the site for any unlawful purpose, harassment, or impersonation; not to scrape the site or access it by automated means; not to attempt to manipulate points, entries, or games; and not to interfere with the operation of the service.

14. Intellectual property

Content on this site is owned by the publisher or its licensors. You may share links to our content freely. You may not republish substantial portions of our content without our written permission.

15. Third party links

Links to government offices, school districts, and other third party sites are provided for convenience. We do not control and are not responsible for the content of any third party site.

16. Fair housing

Equal Housing Opportunity. We serve all persons regardless of race, color, national origin, religion, creed, sex, sexual orientation, gender identity or expression, age, disability, familial status, marital status, military status, lawful source of income, or any other class protected under the NYS Human Rights Law.

We do not provide school ratings, rankings, test scores, or comparative neighborhood quality assessments. Where we reference a school district, we link only to that district's own official website.

17. Disclaimer of warranties

The site and all content are provided as is and as available, without warranties of any kind, express or implied, to the fullest extent permitted by law.

18. Limitation of liability

To the fullest extent permitted by New York law, STER GROUP LLC and its officers, members, employees, and agents will not be liable for any damages arising out of or related to your use of, or inability to use, this site or its content. This limitation applies regardless of the theory of liability.

19. Indemnification

You agree to indemnify and hold harmless STER GROUP LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these terms or your misuse of the site.

20. Termination

We may suspend or terminate your membership if you violate these terms. You may leave the community at any time by contacting us at the email address in the Contact section below, and we will remove your membership.

21. Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a new Last updated date. Your continued use of the site after changes are posted means you accept the updated terms. Changes are never applied retroactively to consent you have already given.

22. Governing law and venue

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any legal action arising out of or related to these terms or this site must be brought in the state or federal courts located in Suffolk County, New York.

23. Dispute resolution

Any dispute arising out of or related to these terms or this site will be resolved in accordance with the governing law and venue provisions in Section 22.

24. Accessibility

We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier on this site, please let us know using the contact method below and we will work to address it.
